
....The young boy, Joey Cosmillo, fell into the family pool in January. He was resuscitated but suffered brain damage and now cannot walk, talk or swallow. He lives in a nursing home and eats and breathes through tubes.
Casselberry police Sgt. Andrea Eichhorn alleges the boy's family left a puddle of water on the floor, causing her fall during the rescue efforts. She broke her knee and missed two months of work.

You have to look at both sides to this issue and can sympathize with an officer hurt on the job and not enough money to pay the subsequent medical bills. But, how do you sue the family? That's just wrong.
I agree. I'm sure hes has Workman's Comp. that should cover medical costs and lost wages.
In the article it said that workman's comp didn't cover all of it, she's only suing for what it didn't cover. It's still appalling! The family now has a 1 y/o vegetable...
And they likely don't have enough to pay for all his care. Who should they sue?

Oh come on ! The kid feel in the pool, of course there is going to be water around, and no, I don't think the family left water so the officer would fall.
The officer has insurance, they are in high risk jobs. Yes it is too bad about the injury, but that does happen. You don't want to start making people think twice before calling 911 ! "gee is the officer going to sue me if they get injured ?"
It's a poor decision to sue however I am confident she will not win the case which will create some case law to help dissuade future people from trying a stunt like that. Bad things in life unfortunately happen and often they aren't anybodies fault.
Update:
Eichhorn's attorney, David Heil, sent a fax to Local 6 News that stated Eichhorn said it was in the best interest of herself and her family, friends and the Casselberry Police Department to dismiss the lawsuit.
